Research paper: “Feasibility of market value as criterion for fair compensation: Expropriation in ancient Cairo”

“Feasibility of market value as criterion for fair compensation: Expropriation in ancient Cairo” is a research paper published as a part of the “Arab Land Initiative” through the support of the “Global Land tool Network - GLTN” and the UN-Habitat. The paper is published in a crucial time of large-scale expropriation in the historic city, simultaneous with changes to the Egyptian law for the expropriation for the public benefit. The Egyptian constitution requires fair compensation for expropriation. However, the expropriation law bases compensation solely on market value. The research explores the limitation of this basis as well as the processes of expropriation and compensation in law and practice, leading to a more critical analysis of the benefits and harms of the current projects. The paper creates a framework based on literature and, through a case study strategy, develops the framework to fit with the case of Historic Cairo.
